Status of the General Terms and Conditions: January 2025

Art. 1 Contractual partners
These terms and conditions contain the only terms and conditions applicable between you and Repich Sport & Shooting SA (here Repich Sport), Via ai Gelsi 11, CH- 6930 Bedano. We are your contractual partner. The following terms and conditions apply to the purchase of all goods that are offered by Repich Sport in the context of the online shop operated by Repich Sport.

Art. 2 Stipulation of the contract
2. 1 The presentation of the offered goods in the online shop does not represent a binding offer, but rather a non-binding online catalog.
2.2 By clicking the "Send Order" button, you issue a binding order for the goods included in the shopping cart, according Art. 187 ff. CC (Code Civil of Switzerland) and you confirm, that you have red and accepted the general terms and conditions of Repich Sport.
We will confirm your order via e-mail. This order confirmation does not represent acceptance of your order, but is to merely inform you that we have received your order. The contract for purchase between you and Repich Sport is valid only if the order has been regularly paid. After that we will send you the ordered goods and we confirm the done shipment with a second e-mail, the shipment notice. There exists no contract for purchase for goods which are not included in the confirmation of shipment.
2.3 The price shown in the online shop is intended NET Price in Swiss Francs without VAT and all other duties, that can be different from country to country. If you live in Switzerland the Swiss VAT will be added, while if you live in another country outside from Switzerland, the VAT and the other duties of the import country will be charged separately on your account from the custom authority of your country.

Art. 3 Data protection
3.1 We use your data to process your order. All data are stored and handled by Repich Sport in compliance with the relevant Swiss rules of the federal act on data protection and the relevant rules of Teleservices Data Protection.
3. 2 We do not provide your data to third parties without your explicit consent, which can be revoked at any time. This does not include our service partners that need data forwarded for order processing (the shipping company charged with the delivery, for example or Finance Institutes). In these cases, however, the extent of the data forwarded is limited to the minimum required.
3.3 If you have subscribed to our Newsletter, we will send you informations about our goods and offerings via e-mail. You may unsubscribe from the newsletter at any time.
3.4 You have a right to information about your stored data, and to correct, block and if necessary delete it at any time without charge. Please contact us via e-mail at info@repichsport.ch or send us your request by mail.

Art. 4 Delivery times and shipping costs
4.1 We normally deliver your goods within 7 days, if no other delivery time was specified in your shopping cart at the time of your order. Specifications regarding the delivery times are non-binding to the extent that the delivery deadline was not promised in a binding manner and in a written form by way of an exception.
If the ordered goods are not deliverable within the delivery time specified below, for instance as a result of great demand, then we will promptly inform you about the delay by email.
4.2 In case of cancellation of the purchase contract, they must be sent back to Repich Sport on your own charge and risk within 7 days from receiving the package. It’s forbidden in that case, before sending back the good, to manipulate on the electronic board.
4.3 Only after receipt of the goods in a perfect condition, Repich Sport will refund the price paid to Repich Sport to you deducting the commission fees paid by Repich Sport. The other charges likes Taxes which had been paid in the foreigner country by you, Repich Sport has no obligation to refund them.

Art. 5 Terms and conditions of payment
The purchase price is immediately due with an order. Payment for the goods occurs by credit card or bank transfer.

Art. 6 Retention of title
The goods remain our property until payment in full. If you fall into default in payment by more than seven days, we have the right to withdraw from the contract.

Art. 7 Cancellation instructions and further implications
7.1 Right of cancellation
7.1.1 You have the right cancel your contractual declaration within 7 days in written form (by e-mail) without providing reasons, by sending the item back. The 7 days period begins after receipt of items.
7.1.2 To respect the time of cancellation, please send back the right of cancellation form together with the purchased item and with proof of the transport company that you have sent back the item.
7. 2 Further implications by cancellation
7.2.1. In the event of a valid cancellation, the payments received by each party are to be returned and if the buyer requests a credit note can be issued. If the payment has been done by Credit card, the commission fees paid by Repich Sport will not be refunded to you.
7.2.2 The items must be sent back whole and in a perfect condition, in the original package. The items should not be used for personal use or be manipulated. The no respect of these rules or in case the items are damaged, you loose the right of compensation and Repich Sport will not refund the amount of your contract in any of these cases.
7.2.3. In case the transport company damages or looses the packages, Repich Sport will refund the buyer, if the items were correctly insured by the transport company and you have submitted it the proof to Repich Sport that the package has been sent and a valid research by your side has been done.
7.2.4 In case of defect, the buyer should notify this to the Repich Sport immediately after having received the goods and must send them back to Repich Sport within 7 days with a clear notification of the done insured shipment.
In case of defectives goods from the manufacturer, Repich Sport will return you the perfect good as Repich Sport has received the defective goods back.

Art. 8 Warranty
8.1. The warranty for the electronic Bluetooth is 2 years in case of manufacturer defects.
8.2. The User is not allowed to repair/modify the electronic board, or remove any parts of it. These actions will cause the immediate expiration of warranty.
8.3. If the User discovers a problem as per 7.2.4, it should be immediately notified to Repich Sport.
8.4. In case the User needs to send back the electronic board, he should use the Form and notify Repich Sport of the shipment with all shipment datas within 7 days. (see also Rules in 7.2.2 -7.2.4.).

Art. 9 In case of disputes
Valid is the law of Switzerland as any other laws here applicable, under exclusion of the UN Convention on Contracts for the International Sale of Goods. If no any special other legal venue has been agreed, Lugano is the legal venue for all disputes.
